Abstract

This paper explores the ways for establishing the justiciability of education, considered a human right. It examines the content of the right to education and reviews the international legal framework of education, and then proceeds to summarize key aspects. Finally, the analysis leads us to visualize the pathways through which it can enforce the justiciability of the right to education, and the impact on the situation of the affected in the education system and the society.

Miembro del Comité de Expertos sobre los Derechos de las Personas con Discapacidad de Naciones Unidas, Relatora Especial del Protocolo Facultativo de la Convención de Naciones Unidas / CDPD. Integrante del Consejo Asesor del Observatorio Hispano – Argentino de las personas con discapacidad y las situaciones de vulnerabilidad. Abogada, Cientista Política, Profesora en Derecho, Investigadora y Consultora. Directora de distintos proyectos jurídicos. Autora de diversas publicaciones y Conferencista a nivel nacional e internacional. Entre los premios recibidos se encuentran: Estrella de la Esperanza Latinoamericana, Colombia (1999), Premio por la Igualdad y la no discriminación, México (2008), Distinción de la Cámara de Diputados de Chile (2008), Reconocimiento de la Asociación Nacional de Educadores Diferenciales de Chile (2008), Premio Elena Caffarena en el Día Internacional de la Mujer (2009) y Distinción del Senado de Chile (2009).
